How to report non-compliance

​â¶Ä‹If you suspect a business or individual is not complying with ºÚÁϳԹÏÍø tobacco retailing laws, smoke-free laws, or illegally selling vaping products, you can make a report using the link below​. 


When to report a retailer

If you believe a retailer is not complying with ºÚÁϳԹÏÍø tobacco retailing laws, or is illegally selling vapes, you should report it to ºÚÁϳԹÏÍø Health. Under ºÚÁϳԹÏÍø tobacco retailing laws, some common practices that retailers are not allowed to do include:

  • ​selling illicit tobacco
  • selling tobacco to people under 18
  • ​displaying illegal advertising material.​
Under ºÚÁϳԹÏÍø poisons laws it is also il​legal for any retailer other than a pharmacy to sell vaping products.

When to report non-compliance with smoke-free laws​

If you believe an indoor or outdoor smoking ban has been broken, you can report this to ºÚÁϳԹÏÍø Health. Some common places people are not allowed to smoke or vape include:​

  • shopping centres
  • cinemas
  • libraries
  • hospitals
  • public swimming pools
  • buses, trains, light rail and ferries
  • public transport stops
  • restaurants and cafes
  • commercial outdoor dining areas.

Other ways to make a report

The quickest and easiest way to make a report is online.​ However, you can also contact your local Public Health Unit (±Ê±á±«)​. The PHU will ask you for:

  • the name and address where the suspected offence occurred
  • the date and time you witnessed the incident
  • details of what you witnessed during the incident.​
